Email hacking laws: I need a specific answers if possible?
Is there penalty for someone who got a hold of your yahoo password with out your consent? Will any email documentation be admissable in a custody hearing from the email hacking?

Welcome to the wild west! Theft is theft. Not sure if your local DA is willing to pursue a non-person crime being that there is so much other crime out there.

FYI, your employer might be entiteld to track what you do on your work computer and that may include obtaining your password for all accounts you open on your work computer.
Depending on the type of hearing, it may be excluded. If police got your password through i’ll gotten gains, the evidence may be inadmissible under the “fruit of the poisionous tree” doctrine, but if it is some other vermin, like an ex or a friend, they might not be penalized for obtaining that stuff.
If you have a savvy attorney, it may be excluded under hearsay rules. The “hearsay dance” is much to complicated to explain. There is no hard and fast rule as there are many exceptions.
Not giving legal advice, I’d try the hearsay objection and object for lack of foundation. And I’d ask the ex wife to lay foundation as to how she got ithe information. The thing about the ex-wife claiming it’s your fiances email, if she got the password from some source, how does she know what some other person didn’t get the password and make up the document? How does your fiance know she (the ex) didn’t make up the document? She’s going to have to prove he sent it before it is admissible.
Basically, he can drag this out by objecting as hearsay and lack of foundation.
FYI, might piss off the judge either way. Or the judge might ask your fiance flat out if he sent it and he better not lie to the judge.
